This e-commerce site www.maisonmarah.fr is published by the company Maison Marah, a simplified joint-stock company with a capital of €1,000, whose registered office is located at 26 E Chemin Lasserre, 31450 Corronsac, registered with the Toulouse Trade and Companies Register under number 901 355 057.



01. Applications of the general conditions of sale

The general terms and conditions of sale (the "GTC") detailed below apply to all orders for products and services placed via the website with Maison Marah by the Customer. The Customer must read the GTC prior to any order.

Maison Marah reserves the right to adapt or modify these General Terms and Conditions at any time. The version of the General Terms and Conditions applicable to any sale is the one appearing online on the website www.maisonmarah.fr at the time of the Order. Consequently, placing an Order requires the Customer's full and unconditional acceptance of the General Terms and Conditions by clicking on the button "I have read and accept the general terms and conditions of sale".

02. Conditions of use of the online store

To place an Order, the Customer must first register on the Site by creating an account containing the Customer's information (the "Account"). The Customer's registration on the Site is validated by Maison Marah after verification of the standard form completed by the Customer. The Customer receives a registration confirmation email.

When creating their Account, the Customer must ensure the accuracy and completeness of the data they provide. The Customer is required to always update their personal information. In the event of an error in the recipient's contact details, Maison Marah cannot be held responsible for the impossibility of delivering Products.

By registering on the Site, the Customer represents and warrants to Maison Marah that they are of legal age and have the legal capacity to enter into a contract. The account is created for an indefinite period and may be deleted at any time. Maison Marah reserves the right to delete the Customer Account for any reason, at its sole discretion.

03. Products

Maison Marah offers handmade interior design items made by local artisans. These are unique pieces, and are handcrafted. The Customer's perception of the Product photographs may not exactly match the actual Products. In any event, Product photographs are for illustrative purposes only and are not binding.

The Products offered for sale are those described on the Site on the day the Customer consults the Site, within the limits of available stocks. These details are automatically updated in real time. However, an error in the update, whatever its origin, does not engage the responsibility of Maison Marah. As such, Maison Marah cannot be held responsible for the cancellation of an Order for a Product due to the exhaustion of stocks. All product descriptions and their pricing are subject to change at any time, without notice and at our sole discretion. We reserve the right to discontinue the sale of a product at any time.


04. Order

Placing an Order on the Site is subject to compliance with the procedure implemented by Maison Marah on the Site, comprising successive stages leading to validation of the Order.

The majority of Products presented on the website are sold on pre-order basis. This means that the ordered product will be manufactured following the order; a certain manufacturing time is assigned to each item and indicated on each product sheet. Once the item's manufacturing is complete, Maison Marah will ship the orders.

The Customer may select as many Products as they wish, which will be added to the shopping cart (the "Shopping Cart"). The Shopping Cart summarizes the Products chosen by the Customer as well as the prices and associated fees. The Customer may freely modify the Shopping Cart before confirming their Order. Validation of the Order constitutes confirmation of the Customer's acceptance of the General Terms and Conditions, the Products purchased, their prices and the associated fees.

For an order containing multiple items, if one of the items is in stock and the other is on pre-order, it is recommended to place two separate orders. In this case, the item in stock will only be shipped with the second item, which may take 2 or 3 weeks depending on the manufacturing time.

A confirmation email summarizing the Order (Product(s), price, availability of the Product(s), quantity, etc.) will be sent to the Customer by Maison Marah. To this end, the Customer formally accepts the use of email for confirmation by Maison Marah of the contents of his Order. Invoices are available in the "my account" section of the Site.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address or phone number provided at the time the order was made.

05. Prices and payment terms

Product prices are indicated on the Site in euros, including VAT, but excluding customs duties and other taxes. Customs duties and other taxes must be paid by the Customer directly to the carrier.

All prices displayed are calculated and include the value added tax (VAT) applicable in France. Products are payable in cash upon actual Order.

Payment for purchases is made by credit card only via the secure platform of our payment service provider Stripe.

The Customer expressly acknowledges that providing their bank card number to Maison Marah constitutes authorization to debit their Account for the amount of the Products ordered. Where applicable, a notification of cancellation of the Order due to non-payment is sent to the Customer by Maison Marah to the email address provided by the Customer when registering on the Site.

The data recorded and stored by Maison Marah constitutes proof of the Order and all past sales. The data recorded by Stripe constitutes proof of any financial transaction between the Customer and Maison Marah.

Maison Marah reserves the right to refuse a payment, and therefore an order, for any reason whatsoever, and more particularly in the event of a supply problem, or any other difficulty concerning the order received.

06. Delivery

Deliveries are made by COLISSIMO, MONDIAL RELAY or CLICK AND COLLECT from Monday to Saturday, depending on the option chosen by the Customer when confirming their Order. The Delivery charges applicable to the Order are those mentioned at the time of the Order.

When Maison Marah is responsible for the delivery of the Product, the risk of loss or deterioration of the Product is transferred to the Customer at the time of Delivery.

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer, of a natural person of his choice or of a legal entity (delivery to his company). In the event that Delivery cannot be made, due to an incorrect delivery address or the Customer's failure to collect his Order from the selected collection point, no reshipment can be made and the Customer will be reimbursed within five (5) days of receipt of the Order by Maison Marah.

When the pre-order ends, the Products are shipped within a maximum period of twelve (12) working days. Please note that Maison Marah only delivers to Metropolitan France. However, if the Products have not been delivered more than 30 days after the order was validated, the Customer may cancel their order and request a refund by contacting Maison Marah at the email address bonjour@maisonmarah.fr .

Shipping costs vary depending on the carrier selected and the total weight of the package and are in addition to the indicated product prices.

Please note that once the Customer has taken possession of the package, by signing the delivery slip, the risks of loss or damage are transferred to them. Therefore, it is important not to sign the delivery slip before having checked the contents of the package and the condition of the Product(s).

If the products do not conform to the order or are damaged, the Customer must refuse delivery, not sign the delivery slip and inform Maison Marah by email. The products will then be returned by the carrier to Maison Marah, in their original packaging carefully closed by the Customer, at no cost to the Customer.

07. Right of withdrawal - Refunds and returns

1. RIGHT OF WITHDRAWAL

    In accordance with article L.221-18 of the Consumer Code, the non-professional Customer has a period of fourteen (14) days from receipt of the Order to exercise his right of withdrawal from Maison Marah, without having to justify his decision.

    The exercise of the right of withdrawal must be done by e-mail to bonjour@maisonmarah.fr .

    The Customer returns the Order at his own expense, without undue delay and, at the latest, within fourteen (14) days following communication of his decision to withdraw in accordance with Article L. 221-21 of the Consumer Code.

    Beyond this period of fourteen (14) days, the sale is firm and final. The Product must be returned in its original packaging, in its original condition, in perfect condition. Any Product arriving damaged, chipped or broken will not be refunded. The return of Products is not supported by Maison Marah.

    2. REIMBURSEMENT OF PRODUCTS RETURNED UNDER THE RIGHT OF WITHDRAWAL

    The reimbursement of the Order by Maison Marah will be made at the latest within fourteen (14) days from the date on which it is informed of the Customer's decision to withdraw. However, the reimbursement is made subject to Maison Marah having been able to recover the Products subject to the return and the reimbursement request.

    Maison Marah will refund using the same payment method that was used to pay for the Order, unless the Customer expressly agrees to use another method. Maison Marah will not be liable for refunds to an expired payment method.

    The refund of an order paid for with an e-gift card will be automatically refunded in credit.

    If the Customer fails to comply with these General Terms and Conditions, Maison Marah will not be able to refund the Products concerned. In all cases, return costs are borne by Maison Marah if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.

    08. Disputes

    Maison Marah reserves the right to translate the Site and its content into any language of its choice. However, only the French language will prevail in the event of a dispute.

    These General Terms and Conditions and the Services provided are subject to French law. In the event of a dispute, the parties will endeavor to reach an amicable settlement. Failing agreement, any dispute will be submitted to the Toulouse Commercial Court.

    If one or more provisions of the T&Cs are held to be invalid or declared null and void pursuant to a law, regulation or following a final decision by a competent court, the other provisions shall retain their full force and scope.

    9. General conditions of sale for professional customers (B2B)

    These General Terms and Conditions apply to all sales of decorative handcrafted items made by the Seller to professional Buyers. Any other document, such as the Buyer's general terms and conditions of purchase, is not applicable unless previously agreed in writing.

    1. Price

    Prices for handcrafted decorative items are listed in euros (€) excluding taxes. Delivery charges, if applicable, are the responsibility of the Buyer and will be specified at the time of ordering.

    2. Payment

    Payment for orders is made by bank transfer or any other payment method agreed upon between the parties. Invoices are payable 50% upon order confirmation and 50% on the day of delivery.

    3. Delivery

    Delivery times are given for information purposes only and are subject to variation depending on product availability and production stages. The Seller undertakes to inform the Buyer in the event of a significant delay. Delivery costs and transport risks are the responsibility of the Buyer.

    4. Retention of title

    The Seller retains ownership of the decorative items until full payment of the price. In the event of non-payment, the Seller reserves the right to recover the products.

    5. Warranty

    Handcrafted decorative items are sold as is. The Seller guarantees that the products match the description. Any complaints must be made within 10 days of receiving the order.

    6. Liability

    The Seller shall not be liable for any indirect or consequential damages under any circumstances. Its liability is limited to the amount of the order.

    7. Disputes & Applicable Law

    These General Terms and Conditions and the Services provided are subject to French law. In the event of a dispute, the parties will endeavor to reach an amicable settlement. Failing agreement, any dispute will be submitted to the Toulouse Commercial Court.

    8. Modifications to the T&Cs

    The Seller reserves the right to modify these General Terms and Conditions at any time. The new terms and conditions will be binding on the Buyer as soon as they are posted on the Seller's website.

    We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check our website from time to time for changes. Your continued access to or use of our website and the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
